Another vacancy

Chief Justice William Rehnquist died today in his Virginia home. With Hurricane Katrina relief and two Supreme Court nominations pending, Congress should have no higher priorities when it returns Tuesday. Of course, there's no guarantee it won't anyway.

I still think it is plausible that Bush could elevate Roberts to Chief Justice although it is now more unlikely. We'll see.

Or, in light of today's news, Bush can go ahead an attempt to get Roberts selected as the next chief justice right from the get-go.

I can't say I agree with Bush on the move, because I think your CJ should be someone that's been on your Supreme Court for a few years, not a newbie. And it doesn't have to be your senior justice, but someone who has worn the robes for a little while.

Sorry, please allow me to gloat here for a minute, I called that one in July and agin a day in advance, although I truly was more speculative since he had already asked for Roberts to replace O'Conner.
